Modi Surname Case: After 133 Days, SC Stays Sentence of Rahul Gandhi

Modi Surname Case: The Supreme Court has reversed the decision 133 days after Rahul Gandhi's removal from Parliament. On Friday, the Supreme Court has given relief to Rahul Gandhi in the Modi surname case on the sentence of 2 years in jail.

The Supreme Court has also questioned the lower court's decision in the Modi surname case. The Supreme Court has also asked 3 questions regarding this.

The Supreme Court said that the punishment in the Modi surname case will affect not only Rahul but also the voters.

What Supreme Court Asked?

1. We want to know why the judge gave the maximum sentence. If the judge had sentenced Rahul Gandhi to 1 year and 11 months, then Rahul Gandhi would not have been disqualified at that time.

2. One Lok Sabha seat will be left without an MP due to the maximum punishment. This is also a matter related to the rights of the voters associated with that seat.

3. There is no doubt that whatever Rahul Gandhi said in the speech was not good at all. Leaders should be careful while speaking in front of the public.

What Benefits will get Rahul from this Decision of the Court?

  • With this decision, Rahul Gandhi's MP membership will be restored, so that he will be able to join the current session.

  • If Rahul Gandhi wants, he can contest in the Lok Sabha elections next year.

Hearing lasted for 15 days in Supreme Court

On July 15, Rahul Gandhi appealed against the decision of the High Court and the trial court in the Supreme Court. The first hearing was held in the Supreme Court on 21 July.

After this, on August 2, the Supreme Court bench heard the arguments of both sides. After this, the Supreme Court reserved the decision till 4 August.

What is the whole matter?

On 11 April 2019, while addressing an election meeting in Kolar, Bengaluru, Rahul Gandhi made a statement regarding the Modi surname. BJP MLA Purnesh Modi filed a defamation complaint against this statement.

This case went on for 4 years in the sessions court and its decision came on March 23 this year, in which Rahul Gandhi was sentenced to two years. Because of this Rahul Gandhi lost his MP.
