Angered by the working style of the Central Bureau of Investigation (CBI), the Supreme Court has asked the agency to tell the success rate. The Supreme Court has sought data on the agency's success rate in court cases, citing inordinate delay in the cases being prosecuted by the CBI. It is believed that the Supreme Court can assess the performance of the CBI. In fact, the Supreme Court expressed displeasure over the filing of an appeal after a delay of 542 days by the CBI in a case and decided to analyze the functioning of the central agency and its performance.
According to the report, the Supreme Court has directed the CBI director to place before the court the number of cases in which the agency has been successful in convicting the accused in lower courts and high courts. The court has also asked what steps the CBI director is taking to strengthen the department with regard to legal proceedings. A bench of Justices Sanjay Kishan Kaul and MM Sundaresh said that there should be some accountability of the CBI.
A bench of two judges, Justice Sanjay Kishan Kaul and Justice M Sundaresh, observed that it is not enough for the agency to merely register the case and investigate, but also ensure that the prosecution is conducted successfully. The bench has sought full details of the ongoing cases and successfully completed cases from the CBI. The CBI has also been asked to give details of how many cases are pending in courts and for how long.
The Supreme Court has pulled up the CBI for the inordinate delay in filing the appeal in the matter. The Supreme Court has now gone a step ahead and decided to analyze the performance of the agency in other cases as well. This bench of the Supreme Court said that we will investigate the success rate of CBI. In fact, the bench was hearing a case related to an appeal filed by the CBI in 2018 in which the Jammu and Kashmir High Court delivered its verdict.
