The Supreme Court on Thursday quashed the stay imposed by the High Court in the matter of giving 75 percent reservation to the residents of Haryana in the private sector. With this decision of the Supreme Court, now the way has been cleared for the people of Haryana to get 75 percent reservation in the private sector. On February 3, the High Court had stayed the law of the Manohar Lal Khattar government of Haryana, in which there is a provision to give 75 percent reservation to the people of the state in the private sector.
A bench of Justice L Nageswara Rao and Justice PS Narasimha also directed the Haryana government not to take coercive action against the employers. Along with this, the court has also requested the High Court to take a decision within four weeks. The bench said that Haryana is directed not to take coercive action against the employers. We do not intend to deal with the matter on its merits and request the High Court to take a decision expeditiously and within four weeks.
High Court order dismissed
The Supreme Court further said that in this case the Punjab and Haryana High Court is directed not to request an adjournment to the parties and to remain present before the court to fix the date of hearing. The order of the High Court, which has been challenged, is set aside as the court has not given sufficient reasons to stay the Bill. Solicitor General Tushar Mehta appeared on behalf of the Haryana government.
Let us tell you that the Punjab and Haryana High Court had on February 3 put an interim stay on the Haryana government's law to give 75 percent reservation to the residents of the state in private sector jobs. The Haryana government has challenged this decision in the Supreme Court. The High Court had ordered an interim stay while hearing the petitions of various industry associations of Faridabad and many other organizations of Haryana including Gurugram.
