Not only this, but many people also say that the ban imposed on alcohol is wrong and they argue that they have the right to eat and drink anything. Is it the same for alcohol, is it your right to drink?

Is it really a fundamental right?

Simply put, drinking alcohol is not a fundamental right. The court has held many times in its decisions that drinking alcohol is not in the category of fundamental right and states can control its sale according to their own.

Even in the year 1960, when Gujarat had upheld the Bombay Prohibition Act 1949, in which way alcohol was banned. Along with this, in section 12 and section 13 of this Act, the state has been empowered to control the sale of liquor according to its own.

However, apart from this, the sale of liquor for industrial purposes has been kept aside, so liquor can be purchased for industrial purposes in the banned states. It is forbidden to drink alcohol.

Although Article 19 (1) (G) says that any person can trade anything according to his own accord, but many things have been kept away from it, which is against society. At the same time, according to Article 47, the state can decide to ban alcohol and it is the responsibility of the state to take any decision regarding health matters in the state.

The policy is different in Kerala

As far as the power given to the state is concerned, each state can make its own policy. Similarly, the sale of liquor is prohibited in 2-3 star hotels in Kerala, but liquor can be sold in 4-5 stars. Because the government believes that the environment there, security is different.

When this policy was challenged, the Supreme Court also continued it, on the basis of which Kerala has a different policy. Similarly, when liquor was banned in Bihar, this decision got many challenges, but the court has made it clear that it is the right of the states.
