A new twist has come in the Lakhimpur Violence case of Uttar Pradesh. The SIT constituted to investigate the matter has also admitted that the entire incident of crushing the farmers with a vehicle was a well-planned conspiracy. The SIT has now also changed the sections imposed on the accused. Union Minister of State for Home Ajay Mishra Teni's son Ashish Mishra will now face a case of murder instead of culpable homicide. Today the accused will also have to appear in court.
The Special Investigation Team (SIT) probing the Lakhimpur Kheri violence on October 3 has applied to the Chief Judicial Magistrate (CJM). Under this, a request has been made to include new sections against 13 accused to make their offense punishable under the charges of attempt to murder. SIT Investigating Officer Vidyaram Diwakar applied to the CJM court last week to add new sections to the warrant in place of sections 279, 338, and 304A of the IPC.
Deputy CM Keshav Prasad Maurya was going on a tour of Lakhimpur Kheri as per the schedule. Cars were going to receive them. These vehicles were said to belong to Ashish Mishra, son of Union Minister Ajay Mishra. On the way, farmers started protesting in the Tikunia area. This led to a clash. Later it was alleged that Ashish Mishra overpowered the farmers, killing 4 people. After the death of the farmers, the matter escalated and violence broke out. Four people including the driver of the BJP leader died in the violence. Altogether 8 people have died in this violence so far. And after this incident, there was a lot of resentment in the people.
Keeping in mind that the situation should not deteriorate after this violence, the internet was shut down, while a case has been registered against Union Minister's son Ashish Mishra at Tikunia police station.
These allegations against him have been rejected by the Union Minister and his son. Union Minister Ajay Mishra had told that he said that some people had attacked the convoy, due to which the driver was injured. He said that three of our workers and one driver have died and the vehicles were also set on fire. Has gone. He says that he will also file a case in this matter. At the same time, his son Ashish Mishra claimed that he was in Banwanipur since 9 am. He said, three of our vehicles had gone to receive the Deputy Chief Minister for an event. On the way, some miscreants pelted stones, set cars on fire, and beat 3-4 of our workers with sticks. He has also demanded a judicial inquiry into this violence.
The sections have been changed after investigation on 14 people including Ashish Mishra, the main accused in the Lakhimpur incident. All the accused are accused of committing the crime by deliberate planning. The SIT has removed IPC sections 279, 338, 304A and imposed 307, 326, 302, 34,120 B, 147, 148,149, 3/25/30. The investigating officer said that the incident was well-planned and a deliberate act and not negligence. No one has been killed due to carelessness, thinking that the whole conspiracy has been executed.
SIT Chief Investigating Officer Vidyaram Diwakar has made it clear that this is not a case of accidental death while driving negligently and negligently. There is a case of conspiracy to crush the mob, murder, attempt to murder as well as dismemberment due to a well-thought-out conspiracy. The Inquiry Officer after amending sections 279, sections 307 (murder attempt), 326 (voluntarily causing grievous hurt by dangerous weapons or means), 34 (acts done by several persons with common intention), 279 ( Speeding vehicle or riding on a public road), 338 (whoever so haste or carelessly causes grievous hurt to any person) and 304A (negligent cause of death).
